Abstract

Academic freedom is an area of interest for many academic faculty and students who are typically protected from persecution or retribution from what they say within the context of the university. There is significant history of this freedom, and this protection has been challenged and as colleges and universities have focused attention on diversity and inclusion efforts, some have considered if this hinders academic freedom. The growing criticism of what is referred to as speech codes (limits on free speech) has created discussion in the academic community as to what extent, if at all, these limits negatively impact the spirit of free speech. Several of John Dewey’s works provide guidance on this topic, and in this chapter, the authors examine its relevance to academic freedom.

Abstract

The law-oriented short stories and novels of lawyer/English professor John William Corrington are receiving increasing attention from legal scholars. However, no one has analyzed the science fiction screenplays he co-wrote with his wife, Joyce, from a legal perspective. This article analyzes two such screenplays and concludes that they are “Socratic” texts whose narrative structures and epistemological processes work in much the same way that the traditional participatory exchange works in law school. My analysis explores the links between law, allegory and science fiction as intersecting methods to imagine the possibilities for the future.

Abstract

Purpose

This paper seeks to analyze the applicability of the time‐tested margin of safety principle from value investing to corporate strategy.

Design/methodology/approach

The main source of this paper is the book Margin of Safety, supplementation materials, including a discussion with the book's author, Seth Klarman, were also referenced.

Findings

The paper finds that the margin of safety principle is broadly applicable to corporate strategy in areas such as M&A, hedging, balance sheet management, share buybacks, special dividends, divestments, and cash management. Each of these areas is discussed in the paper and illustrated by way of timely examples as part of the analysis.

Research limitations/implications

Further research could be conducted into valuation methods in general, including the method practiced by noted value investors. Research could also be conducted into the margin of safety principle and its applications in corporate strategy, corporate finance, strategic risk management, shareholder communications, and operations management.

Originality/value

This is the first paper that the author is aware of that analyzes the applicability of the investment‐based margin of safety principle to corporate strategy and strategy‐related initiatives.
