Abstract

The traditional date for the opening of the Silk Road was 105 BC when the Chinese drove halfway across Asia to link up with a like route running from the Mediterranean to Central Asia, but in fact the Silk Road was some 2000 years older and for some 4000 years was the main avenue of communication between China in the East and the Mediterranean in the West. China was the sole producer of the West's silks until the 5th century and in return desired jade, lapis lazuli, delicately coloured glass and Central Asian horses (Franck & Brownstone 1986).

Abstract

Purpose

In order to secure a proper execution of sporting competitions, national governing bodies of professional football leagues apply specific regulatory procedures. In this context, special focus is placed on requirements that are supposed to ensure financial stability of clubs. They, in turn, help avoid negative economic externalities, i.e. the problem that financial difficulties from one club can affect other clubs and stakeholders due to the interdependent relationships of the competition. These regulations on a national level in European professional football leagues show several significant differences. Therefore, the purpose of this paper is to comprehensively analyze financial regulatory procedures of professional football leagues to generate possible improvements of the regulations in detail.

Design/methodology/approach

Using a document analysis of the regulation books of the English Premier League and German Bundesliga (BL), this study compares the regulatory procedures of those important European professional football leagues. Further evaluation was performed through a qualitative content analysis to develop a category system including six categories with 72 criteria from deductive and inductive procedures. For more advanced coding, an assessment scale was integrated.

Findings

Compared to the Premier League, the regulation of the BL points to a more intensive regulation in all categories and across all analyzed indices. The results of both leagues partially reveal that assessment and monitoring requirements tend to be ineffective, which can substantially endanger the achievement of the whole monitoring process’ aims. The intention to ensure the financial stability for securing the league competition can be missed in such a situation and negative economic externalities cannot be prevented effectively.

Originality/value

For the first time, this study includes all relevant requirements of financial club assessment and monitoring. Thereby, an abstract comprehensive and systematic structure for professional team sports leagues is described and allows for a concrete international comparison of two European professional football leagues. At the end, several approaches to improve the regulatory framework are provided.

Abstract

Purpose

For the electromagnetic simulation of electrical machines, models with different ranges of values, levels of detail and accuracies are used. In this paper, numerical and two analytical models of an induction machine (IM) are analysed with respect to these aspects. The purpose of the paper is to use these analyses to discuss the suitability of the models for the simulation of various physical quantities of an IM.

Design/methodology/approach

An exemplary IM is simulated using the two-dimensional numerical finite element method, an analytical harmonic wave model (HWM) and an extended HWM. The simulation results are analyzed among themselves in terms of their level of detail and accuracy. Furthermore, the results of operating map simulations are compared with measured operating maps of the exemplary machine, and the accuracy of the simulation approaches is discussed in the context of measurement deviations and uncertainties.

Findings

The difference in the accuracy of the machine models depends on the physical quantity of interest. Therefore, the choice of the simulation method depends on the nature of the problem and the expected range of results. For modeling global machine quantities, such as mean torque or losses, analytical methods such as the HWM s are sufficient in many applications because the simulation results are within the range of measurement accuracy of current measurement systems. Analytical methods are also suitable for local flux density curves under certain conditions. However, for the simulation of the influence of local physical effects on the machine behavior and of temporally highly resolved quantities in saturated operating points, the accuracy of the analytical models decreases and the use of the finite element method becomes necessary.

Originality/value

In this paper, an extension of the HWM is used to calculate the IM, which, in contrast to the HWM, models the saturation. Furthermore, the simulation results of the different electromagnetic IM models are put into the context of the uncertainty of a measurement of several identical IMs.

Abstract

Purpose

This chapter seeks to reveal what are the implications of the corporate social responsibility (CSR) debate on international investment law by focusing on the specific example of public health. The right to health is one of the human rights secured in international law and in the national legislation of a majority of States. This chapter will provide examples of investment cases concerning tobacco control measures, imposed by the Host States for the purpose of improving public health, though challenged by the tobacco companies under International Investment Agreements (IIAs) in investment tribunals. These specific examples cast rather general questions regarding the legal framework of international investment framework and its role in providing sufficient policy space for Host States to implement the public policies and to ensure that foreign companies adhere to the CSR standards.

Methodology/approach

In order to investigate what are the implications of the CSR debate on international investment law on the example of tobacco industry, the author performs a literature review and analyze two tobacco disputes and its possible implication on the public health debate and protection of foreign investors.

Findings

This case study illustrates the complex paradigm that interlink economic and human rights obligations of States on one side of the spectrum and property rights and social responsibilities of tobacco companies on the other side.

Originality/value of chapter

This chapter addresses a very topical and pertinent issue in public international law, namely: the role of public interest norms in the regime of foreign direct investment.

Abstract

Purpose

The purpose of this paper is to propose a new method that allows to compare the magnetic pressures of different pulse width modulation (PWM) strategies in a fast and efficient way.

Design/methodology/approach

The voltage harmonics are determined using the double Fourier integral. As for current harmonics and waveforms, a new generic model based on the Park transformation and a dq model of the machine was established taking saturation into consideration. The obtained analytical waveforms are then injected into a finite element software to compute magnetic pressures using nodal forces.

Findings

The overall proposed method allows to accelerate the calculations and the comparison of different PWM strategies and operating points as an analytical model is used to generate current waveforms.

Originality/value

While the analytical expressions of voltage harmonics are already provided in the literature for the space vector pulse width modulation, they had to be calculated for the discontinuous pulse width modulation. In this paper, the obtained expressions are provided. For current harmonics, different models based on a linear and a nonlinear model of the machine are presented in the referenced papers; however, these models are not generic and are limited to the second range of harmonics (two times the switching frequency). A new generic model is then established and used in this paper after being validated experimentally. And finally, the direct injection of analytical current waveforms in a finite element software to perform any magnetic computation is very efficient.

Abstract

Purpose

The purpose of this paper is to identify the determinants of arbitrator acceptability and investigate whether the perceived costs of arbitration moderate the relationship between arbitrator acceptability and arbitrator characteristics in international commercial arbitration.

Design/methodology/approach

A two-stage analytic process is used to test the dimensionality, reliability and validity of each construct and then the proposed hypotheses.

Findings

The findings show that the five constructs of arbitrator characteristics – reputation, practical expertise, legal expertise, experience and procedural justice – statistically significantly explain arbitrator acceptability. Moreover, perceived cost of arbitration moderates the relationship between arbitrator acceptability and arbitrator characteristics. However, the moderating effect of perceived costs of arbitration is not equal across characteristics.

Research limitations/implications

Knowledge regarding potential moderators of the strength of the indicators of arbitrator acceptability will be useful to future researchers in determining which variables to study in arbitrator selection research.

Practical implications

Useful guidelines in the selection of an international arbitrator are proposed.

Originality/value

This study contributes to arbitrator acceptability literature through the suggestion of a hypothesized model of arbitrator acceptability with auxiliary hypothesis of reputation in international contexts. In addition, this study investigates the moderating role of perceived cost of arbitration on the relationship between arbitrator acceptability and arbitrator characteristics.

Abstract

Purpose

The purpose of this paper is to focus on the mechanical bearing load caused by the unbalanced magnetic pull (UMP), which is studied in detail. The applied approach is based on an analysis of static and dynamic eccentricities at different positions and different amplitudes. The influence of the operating points is calculated to show the effective bearing load for machines operating at different speeds. The decreasing lifetime of the applied bearings is examined and evaluated in detail.

Design/methodology/approach

To evaluate the proposed methodology a permanent magnet synchronous machine (PMSM) with buried magnets is used. To consider effects of slotting and saturation, a finite element (FE) model is employed. The Monte Carlo method is used to determine the most likely amplitudes of the eccentricities. Calculating the UMP for all possible operating points using a control strategy for the machine and coupling this results with a drive cycle, determines the effective force acting on the bearing.

Findings

It has been shown that the position of the eccentricity has a not significant influence on the behavior of the UMP and may therefore be neglected. The amplitude of the eccentricity vector influences the amplitude of the UMP including all harmonic force components. For technical relevant eccentricities, the influence is approximately linear for the average and the dominant harmonics of the UMP. In most cases, it is sufficient to displace the rotor at an arbitrary position and amplitude. It is sufficient to simulate one type of eccentricity (static or dynamic) with an arbitrary value of displacement (rotor or stator) to evaluate all possible airgap unbalances. Using stochastic simulations of the eccentricity amplitudes enables an a priori design and lifetime estimation of bearings.

Originality/value

This paper gives a close insight on the effect of mechanical bearing load caused by rotor eccentricities. The effect of the position of the eccentricity vector, the operational range and a drive cycle are considered. A stochastic simulation and an empirical lifetime model of one bearing gives an example of using this methodological approach.

Abstract

Purpose

The purpose of this paper is to focus on the frequency-dependent non-linear magnetization behaviour of the soft magnetic material, which influences both the energy loss and the performance of the electrical machine. The applied approach is based on measured material characteristics for various frequencies and magnetic flux densities. These are varied during the simulation according to the operational conditions of the rotating electrical machine. Therewith, the fault being committed neglecting the frequency-dependent magnetization behaviour of the magnetic material is examined in detail.

Design/methodology/approach

The influence of non-linear frequency-dependent material properties is studied by variation of the frequency-dependent magnetization characteristics. Two different non-oriented electrical steel grades having the same nominal losses at 1.5 T and 50 Hz, but different thickness, classified as M330-35A and M330-50A are studied in detail. Both have slightly different magnetization and loss behaviour.

Findings

This analysis corroborates that it is important to consider the frequency-dependency and saturation behaviour of the ferromagnetic material as well as its magnetic utilization when simulating electrical machines, i.e., its performance. The necessity to change the magnetization curve according to the applied frequency for the calculation of operating points depends on the applied material and the frequency range. Using materials, whose magnetization behaviour is marginally affected by frequency, causes a deviation in the flux-linkage and the electromagnetic torque in a small frequency range. However, analysing larger frequency ranges, the frequency behaviour of the material cannot be neglected. For instance, a poorer magnetizability requires a higher quadrature current to keep the same torque leading to increased copper losses. In addition, the applied iron-loss model plays a central role, since changes in magnetization behaviour with frequency lead to changes in the iron losses. In order to study the impact, the iron-loss model has to be capable to incorporate the harmonic content, because particularly the field harmonics are influenced by the shape of the magnetization curve.

Originality/value

This paper gives a close insight on the way the frequency-dependent non-linear magnetization behaviour affects the energy loss and the performance of electrical machines. Therewith measures to tackle this could be derived.

Abstract

Purpose

Over the past two decades, the application of most-favoured-nation (MFN) clauses in international investment agreements (IIAs) to dispute settlement matters has generated controversy. The purpose of this paper is to help resolve some of the controversies by examining the rule of law issues that may arise from such application of MFN.

Design/methodology/approach

The study describes controversies regarding the application of MFN to dispute settlement as per the extant literature on the subject. It explores the elements of rule of law in investor-state arbitration. The paper then analyses the implications of applying MFN to dispute settlement matters for the elements of rule of law. Based on such analysis, the study argues that the application of MFN to dispute settlement matters undermines certain elements of rule of law.

Findings

The paper has outlined the relevant elements of rule of law in investor-state arbitration as access to dispute settlement; judicial (or tribunal) independence, fairness and impartiality; consistency and predictability of law and decisions; transparency; accountability and subjection of dispute forums and systems to law. It found that the application of MFN undermines various components of rule of law, in particular of consistency and predictability and the requirement of tribunals to adjudicate within the limits of the law.

Originality/value

The findings of this study will help future investor-state arbitral tribunals to decide on the application of MFN to dispute settlement matters.
